1. Agreement to Terms

By accessing and using FontCAD (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Description of Service

FontCAD is a Software as a Service (SaaS) platform that provides tools for creating, editing, and exporting custom fonts. The Service includes:

• Web-based font creation and editing tools
• SVG import and font export capabilities
• Cloud storage for font projects
• Advanced font editing features including transform, pattern, and path operations
• Export functionality for TTF, OTF, WOFF, and WOFF2 formats

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate and current information during registration

4. Subscription and Payment

FontCAD offers the following subscription plans:

• Monthly Plan: $10 per month, billed monthly
• Yearly Plan: $100 per year, billed annually

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time without penalty.

5. Cancellation

Subscription Cancellation: You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period.

6. Intellectual Property Rights

Your Content: As between you and FontCAD, you retain whatever ownership rights you lawfully hold in fonts, designs, glyphs, and files you create or upload. FontCAD does not acquire ownership of your work merely because you use the Service.

You grant FontCAD a limited, non-exclusive license to host, copy, parse, convert, modify, display, and transmit your content only as reasonably necessary to operate, secure, and improve the Service, fulfill your requests, and provide features you choose, including global sharing.

Our Service: The Service, including all software, designs, text, graphics, and other content, is owned by FontCAD and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

7. User Content and Conduct

You are solely responsible for the content you create, upload, process, share, and export. Each time you upload or export a font, you represent and warrant that you own or have all licenses and permissions necessary for the requested uses, including storage, processing, modification, conversion, export, use, and distribution as applicable. You agree not to:

• Upload content that infringes on third-party intellectual property rights
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service to create fonts containing offensive, harmful, or inappropriate content
• Resell or distribute fonts created using our Service without proper authorization
• Use the Service in any manner that violates applicable laws or regulations

8. Permitted Use

FontCAD is designed for creating, editing, and exporting custom fonts for personal, commercial, or production use. Our Service is a software tool, and you may only use it for lawful purposes that comply with all applicable laws and regulations. You agree not to use FontCAD for any prohibited purpose, including but not limited to:

• Creating content that infringes intellectual property rights
• Creating content used for fraudulent or deceptive purposes
• Any unlawful or prohibited activities

9. Data Storage and Privacy

We store your font projects and account information on secure cloud servers. We are committed to protecting your privacy and data security. Your data will not be shared with third parties except as necessary to provide the Service or as required by law.

10. Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11. Limitation of Liability

To the maximum extent permitted by law, FontCAD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or your data
• Any interruption or cessation of the Service
• Any bugs, viruses, or harmful code transmitted through the Service

12. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.

14. Changes to Service or Pricing

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Pricing may change with 30 days' notice. Existing subscribers will maintain their current pricing for the remainder of their billing period.

15. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users, us, or third parties, or for any other reason.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

17. Font License Screening and Exports

FontCAD may inspect embedded font metadata and technical embedding flags and may warn about or refuse files with detected restrictions. Metadata can be missing, inaccurate, ambiguous, or legally insufficient. Screening is an operational safeguard, not legal clearance, and does not transfer your responsibility to verify the governing license and applicable law.

Exported files may preserve or incorporate metadata from uploaded files. You are responsible for the legality of every export and for satisfying attribution, notice, source-code, distribution, embedding, trademark, and other license obligations.

18. Global Sharing and Intellectual Property Complaints

Making a profile global authorizes FontCAD to make its profile and glyph data available to other FontCAD users. You must have the rights necessary for that sharing. FontCAD may restrict or remove content, disable sharing, preserve relevant records, or suspend repeat infringers when it receives a sufficiently supported complaint or otherwise reasonably believes rights may be violated.

19. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FontCAD and its operators from third-party claims, damages, liabilities, costs, and reasonable legal fees arising from your content, your use or distribution of a font, your violation of another party's rights, or your breach of these Terms.
